Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Miracle mobile application ("App") operated by Vibrate, LLC ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into a binding agreement
  • You agree to comply with these Terms and all applicable laws

If you do not agree to these Terms, you must not use the App.

2. Medical Disclaimer

IMPORTANT: Miracle is for wellness and relaxation purposes only.

The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Sound healing, Solfeggio frequencies, and healing frequencies are not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have experienced through the App.

If you think you may have a medical emergency, call your doctor or emergency services immediately.

3. Subscription Terms

Trial Period: Miracle offers a 7-day free trial for new users. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin.

Pricing: The Miracle subscription is priced at $39.99 USD per year (pricing may vary by region). All fees are in U.S. dollars unless otherwise stated.

Auto-Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel at least 24 hours before the renewal date. You will be charged through your Apple ID account.

Cancellation: You may cancel your subscription at any time through your Apple ID settings:

  • Go to Settings → [Your Name] → Subscriptions
  • Select Miracle and tap “Cancel Subscription”
  • Cancellation takes effect at the end of the current billing period

No Refunds: All purchases are final. We do not offer refunds for unused portions of your subscription, except as required by law. If you cancel, you will retain access until the end of your current billing period.

Price Changes: We reserve the right to change subscription prices at any time. Price changes will apply to new subscribers and renewing subscriptions after notice is provided.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up-to-date

You may not share your account with others or transfer your account to another person.

5. Community Guidelines (“Wall of Love”)

The Wall of Love is a community space for sharing experiences and support. By participating, you agree to:

Prohibited Content: You may not post content that:

  • Is illegal, harmful, threatening, abusive, harassing, or defamatory
  • Contains hate speech, discrimination, or promotes violence
  • Violates intellectual property rights or contains copyrighted material
  • Is sexually explicit, pornographic, or inappropriate
  • Contains spam, advertising, or commercial solicitation
  • Impersonates another person or entity
  • Contains viruses, malware, or malicious code

Moderation: We reserve the right to:

  • Remove any content that violates these Terms
  • Suspend or terminate accounts that engage in prohibited behavior
  • Modify or discontinue the Wall of Love feature at any time

Content Ownership: You retain ownership of content you post, but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the App.

6. Intellectual Property & Content License

All content within the App, including but not limited to:

  • Music and audio recordings by “Healing Miracle Frequencies”
  • App design, interface, and graphics
  • Text, images, and multimedia content
  • Software, code, and algorithms

…is protected by copyright, trademark, and other intellectual property laws and is owned by or licensed to Vibrate, LLC.

Your License: Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Stream and listen to content within the App
  • Use the App for personal, non-commercial purposes

Restrictions: You may not:

  • Download, copy, reproduce, or distribute any content
  • Modify, reverse engineer, or create derivative works
  • Use the App or content for commercial purposes
  • Remove copyright notices or proprietary markings
  • Use automated tools to access the App (bots, scrapers, etc.)

7. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Interfere with or disrupt the App or servers
  • Attempt to gain unauthorized access to any systems
  • Use the App in any way that could harm, disable, or impair it
  • Collect or harvest user data without permission

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of content

We do not guarantee that the App will meet your requirements or that any errors will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBRATE, LLC SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Personal injury or property damage
  • Any damages arising from your use of or inability to use the App

In no event shall our total liability exceed the amount you paid for the subscription in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vibrate, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use of the App
  • Your violation of any rights of another party
  • Content you post on the Wall of Love

11. Termination

We may suspend or terminate your account and access to the App at any time, without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Any reason at our sole discretion

Upon termination, your right to use the App will immediately cease, and you will lose access to all content and data.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via:

  • Email notification to your registered address
  • In-app notification
  • Posting on our website

Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as required by law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
